The Kharkiv National University of Radio Electronics has established and operates a labour dispute commission (hereinafter referred to as the LDC). The activities of the labour dispute commission are provided for in Chapter XV of the Labour Code of Ukraine “Individual Labour Disputes”.
The labour dispute commission at the university is elected by the conference of the labour collective. It consists of four people: the chairman of the commission, two members of the commission and the secretary of the commission. The LDC has a seal of the established sample. The Labour Dispute Commission is a mandatory primary body for the consideration of labour disputes that may arise at the university. A labour dispute is subject to consideration by the commission if the employee has not settled the disagreement in direct negotiations with the rector of the university.
The employee shall apply to the commission within three months from the date when he/she learned or should have learned about the violation of his/her right. An employee’s application received by the commission must be registered.
The LDC considers the labour dispute within ten days from the date of filing the application in the presence of the employee who filed the application. In the absence of the employee, the dispute is considered upon his or her written request.
If the employee fails to appear, consideration of the application is postponed until the next meeting. If the employee fails to appear again without valid reasons, the Commission may decide to withdraw the application from consideration, which does not deprive the employee of the right to submit an application again within three months.
The CTS has the right to summon witnesses to the meeting, to instruct specialists to conduct technical, accounting and other inspections, to demand the necessary calculations and documents from the rector. A meeting of the CTS shall be deemed competent if it is attended by at least 2/3 of the members elected to its composition. The minutes of the meeting are kept by the chairman or his deputy and the secretary.
The CCC makes decisions by a majority vote of its members present at the meeting. A copy of the commission’s decision is handed to the employee within 3 days.
The decision of the labour dispute commission shall be implemented within 3 days after the expiry of the 10 days provided for its appeal.
According to the law, the Labour Disputes Commission consists of representatives of the university administration and representatives of the primary trade union organization.
